Department of Education and Department of Justice's Title IX Special Investigations Team is examining OSPI's policies that permit transgender students to participate in sports and access facilities aligned with their gender identity. OSPI defends its practices, emphasizing the importance of maintaining student safety and privacy, particularly for those who may face familial rejection.

The investigation is informed by an OSPI inquiry into La Center School District, which found discrimination against students based on gender identity. U. S. Secretary of Education Linda McMahon condemned Washington's approach, claiming it infringes on parental rights and female equality in athletics. In contrast, OSPI argues that federal actions threaten nearly two decades of established protections for transgender individuals in Washington.
