WA gun shop asks US Supreme Court to review high-capacity magazine ban

Gator’s Custom Guns in Kelso has petitioned the U. S. Supreme Court to review Washington's ban on high-capacity ammunition magazines, which the state Supreme Court upheld in May. The state court ruled in a 7-2 decision that magazines over ten rounds are not considered "arms. " Store owner Walter Wentz hopes the Supreme Court will overturn this decision, stating, "I look forward to exercising our rights.

" A spokesperson for the state attorney general's office affirmed the ban's constitutionality, citing consistent rulings from lower courts. Gator’s attorneys argue the ruling contributes to a division among federal courts about whether magazines are "arms," calling for Supreme Court intervention. The case underscores the complexity of firearm regulations, particularly in light of the Supreme Court's Bruen decision, which mandates adherence to historical traditions of firearm regulation. In 2022, the Bruen ruling set a precedent for evaluating firearm laws against historical context. The Washington law remains in effect, allowing ownership of high-capacity magazines but prohibiting their sale or importation.
