An investigation into Spokane Valley Councilmember Al Merkel has concluded that he violated both the City Governance Manual and potentially the Washington State Public Records Act. Initiated by a complaint from Councilmember Jessica Yaeger, the investigation examined Merkel's usage of his personal Nextdoor account for posts related to city business. The findings suggest that several of Merkel’s posts are public records that the City cannot retain due to his non-compliance, which could lead to significant legal repercussions. Despite Merkel's claims that his social media content is not city business, the report identifies specific content that contradicts this assertion. Topics of concern include discussions about council debates, complaints about fellow councilmembers, and surveys on city projects.

This marks the second investigation into Merkel’s behavior since he assumed office in January 2024. Since the beginning of the year, the City has received 48 public records requests related to Merkel, underscoring the ongoing scrutiny of his actions. The investigation raises critical questions about accountability and transparency for elected officials in Spokane Valley.
