City of Burien hit with countersuit over minimum wage initiative

The sponsors of Burien's minimum wage initiative have filed a countersuit against the city, accusing officials of obstructing the law and violating open meetings laws. In February 2024, Burien voters approved Initiative Measure No. 1, with 57. 18% voting in favor. The Transit Riders Union alleges that the city is undermining the initiative by failing to enforce its provisions and advertising positions below the minimum wage.

The countersuit claims the city held closed-door executive sessions to authorize its legal challenge, which violates the Open Public Meetings Act. Among five causes of action, the countersuit argues that the city’s actions infringe upon constitutional rights. The sponsors are seeking a declaration that the city's competing ordinance is invalid and demand full implementation of the initiative. This legal battle highlights the tension between local government actions and voter-approved measures. The case continues in King County Superior Court.
