Judge may decide fate of Hangar 420 marijuana retailer in Clearview

The fate of Hangar 420's marijuana shop in Clearview hinges on a decision from a Snohomish County Superior Court judge, who is reviewing the shop's compliance with local regulations. The county argues that Hangar 420's location violates a code restricting the number of marijuana retailers within a 2-mile radius in rural areas. During the hearing, the county attorney asserted that the previous occupancy certificate for The Kushery was voided when it moved, leaving Hangar 420 in violation of the 10,000-foot separation requirement. In contrast, Hangar 420's lawyer argued that the occupancy certificate should remain valid at the property. David Toyer, assisting Hangar 420, filed a code interpretation request earlier this year, which the county confirmed in June as a violation.

Toyer has since filed an appeal, but no hearing date has been set. The outcome of this case could have significant implications for marijuana retail regulations in the area. As of the end of business Friday, the judge had not rendered a decision.
