LIVE Hearing on motion to dismiss case of man charged with killing WSP trooper

Raul Benitez-Santana is charged with the vehicular homicide of Washington State Patrol trooper Christopher Gadd, who died after Benitez-Santana crashed into his cruiser while allegedly driving over 100 mph in March 2024. Defense attorneys filed a motion to dismiss the case, claiming that prosecutors violated state sanctuary laws by soliciting ICE's involvement regarding Benitez-Santana's immigration status. They argue that the prosecution's actions have led to a prejudiced jury pool, exacerbated by negative media coverage portraying Benitez-Santana as an undocumented criminal. The defense describes these actions as “outrageous government misconduct. ” A hearing in Snohomish County Superior Court will determine the fate of this motion, with a decision expected soon.

If the motion to dismiss is denied, a jury trial will begin immediately the following day. Prosecutors are anticipated to file a response to the defense's claims prior to the hearing. The outcome of this case could have broader implications for how immigration status is handled in similar criminal cases.
