Wrongful death lawsuit filed in connection with deadly Fairview plane crash

Kent Walton filed a $10 million wrongful death lawsuit in Multnomah County after his partner, Barbara McDonald, was killed in a Cessna 421C crash on August 31, 2024. The lawsuit names Circle Capital Industrial LLC, Emerald Aircrafters, and the estates of deceased pilots Michael Busher and Jacqueline Whitford. It alleges negligence in maintenance by Emerald Aircrafters, claiming the aircraft was unsafe for flight. The suit also holds the pilots accountable for failing to verify the aircraft's safety and for improper emergency landing decisions. Walton's attorneys, Matthew Clarke and James Anderson, argue that the negligence led to the tragic incident.

The Cessna crashed shortly after takeoff from Troutdale Airport, hitting a power line and an oak tree before striking McDonald's home. This case highlights concerns over aircraft safety and maintenance practices in the aviation industry. KATU has sought comments from Circle Capital and Emerald Aircrafters regarding the lawsuit.
