The city argues that such guarantees would violate City Charter provisions, which grant the Director authority over staffing decisions. Voters also mandated that the Community Board for Police Accountability exercise independent judgment in its duties, further complicating the union's request. The city remains committed to fair negotiations, proposing that transfers for AFSCME-represented employees could occur without the need for formal applications or interviews.

This proposal allows the OCPA Director discretion in approving transfers, aiming for a smoother transition to the new oversight system. Previous bargaining updates indicate persistent discussions without a resolution. The outcome of these negotiations will significantly influence the future of police oversight in Portland.
