Judge No National Guard in Oregon, For Now.

A federal judge has extended a preliminary injunction blocking the deployment of National Guard troops to Oregon until November 7, 2025. US District Judge Karin Immergut issued the ruling after reviewing extensive evidence from a three-day trial involving over 750 exhibits. She determined that Oregon and Portland are likely to succeed in their claims under section 10 of US Code and the 10th Amendment, which implicate federal law violations regarding troop deployment. The ruling keeps the troops federalized but not deployed, preserving the current situation. Immergut criticized the Trump administration's arguments against the injunction, labeling them as flawed and without legal support.

The judge is also reviewing post-trial briefings from both parties, which were filed shortly before her decision. The case has garnered attention as the 9th Circuit Court of Appeals prepares to reconsider the administration's appeal of an earlier restraining order. The Trump administration argues that the National Guard is necessary to protect the ICE facility in Portland, amidst ongoing legal disputes.
