Marvin Boomers family plans to sue Oakland and CHP

Marvin Boomer’s family intends to file wrongful death lawsuits against the City of Oakland, Oakland Police Department, California Highway Patrol, and the State of California following his tragic death in May. Boomer was killed while protecting his partner from an out-of-control vehicle during a police chase. The lawsuits will claim that a dangerous pothole on E. 21st Street contributed to the accident and that police officers failed to render proper emergency medical aid. Civil rights lawyer Michelle Bernard has conducted 37 depositions and received evidence, including video, indicating that the CHP was speeding during the pursuit.

Bernard argues that the released video from the CHP misrepresents the speed and proximity of the pursuit. The family aims to secure damages in the tens of millions of dollars for their loss. Additionally, Bernard will pursue a separate suit against the driver and his insurance within two years. The case highlights ongoing concerns about police conduct and roadway safety in Oakland.
