The Chicago-based restaurant has held the "Smoque" trademark since 2013 and fears that Weber's product will dilute its brand recognition. Co-owner Barry Sorkin expressed that the similar names could mislead customers into believing a connection exists between the restaurant and the smoker. Weber's legal team claims the two brands operate in separate markets, arguing that the names would not cause confusion. A discovery conference is scheduled for August 11, with a decision likely not forthcoming until early 2027.

Smoque BBQ has raised public awareness through social media, where its opposition announcement received significant engagement, including over 1,200 petition signatures. Sorkin acknowledged the legal challenges posed by Weber's corporate strength but emphasized the importance of making their voice heard. The dispute highlights ongoing tensions between small businesses and large corporations over branding and trademark rights.
