Swinomish Tribe settles years-long dispute with BNSF Railway
The Swinomish Tribe settled a protracted trespass dispute with BNSF Railway, which began in 2015 when the tribe filed a lawsuit to halt unconsented train operations on their land. Chairman Steve Edwards highlighted the importance of protecting their homeland and honoring historical treaties. A federal judge had ruled in favor of the tribe, ordering BNSF to pay $400 million for violating a 1991 agreement requiring tribal consent for extensive train operations. BNSF's appeal of this ruling led to mediation, culminating in a new settlement agreement. Under the terms, BNSF can transport one train carrying crude oil per day across the reservation, which aims to reduce the risk of environmental spills.
The tribe anticipates that this lower volume of oil transport will better protect marine habitats.
